1. Overview and Scope

1.1 Legal Entity

DriveIndex is developed and operated by Neon Media, LLC (“Neon Media”, “we”, “us”, or “our”).

1.2 Services Covered

These Terms cover:

The website located at https://driveindex.app (the “Site”)
The DriveIndex desktop application for macOS (“DriveIndex”, the “App”)

Together, the Site and the App are referred to as the “Services.”

2. Eligibility and Basic Terms

2.1 Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding contract.

2.2 Accounts and Contact Information

DriveIndex may not require a user account for basic use; however, certain functions (such as managing licenses or receiving support) may require that you provide contact details such as your name and email address.

You agree to:

Provide accurate and current information when requested
Keep any login or license-related information secure
Notify us promptly of any suspected unauthorized use of your information

You are responsible for all activity that occurs using your purchase details or license information.

3. Scope of the Services

3.1 DriveIndex Website (driveindex.app)

The Site provides information about the DriveIndex app, features, pricing, documentation, and support information. It may allow you to:

Follow links to purchase the app through our payment processor (currently Gumroad)
Access documentation or FAQs
Contact us for support or feedback
Sign up for optional updates or newsletters

3.2 DriveIndex Desktop App

The App is a macOS utility designed to help users index, review, and manage information about their drives and storage devices. The App is distributed as desktop software for macOS and may be updated from time to time.

Use of the App is subject to:

Any end user license terms presented during installation or first launch
The terms and policies of the payment platform (Gumroad) and any other distribution platform if used in the future

3.3 Changes to the Services

We may add, remove, or change features, functionality, or pricing for the Site or App at any time, in our discretion. If we make material changes to these Terms, we will update the “Last updated” date above and may provide additional notice where required by law.

4. Orders, Payments, and Pricing

4.1 Purchases Through Gumroad

DriveIndex is currently sold and licensed through Gumroad. When you purchase DriveIndex:

You will be redirected to Gumroad's checkout or a Gumroad-hosted payment interface.
Gumroad will collect billing information, email address, and other details necessary to process your payment.
Your license or purchase confirmation, along with a download link, will be delivered by email from Gumroad.
Neon Media, LLC is the seller of record, and Gumroad acts as our payment processor and storefront platform.

By making a purchase, you agree to follow Gumroad's terms of service in addition to these Terms.

4.2 Pricing and Taxes

All prices are listed in United States dollars (USD) unless otherwise noted. We may change prices at any time, but changes will not affect a completed purchase that has already been charged, except in the case of obvious pricing errors.

You are responsible for any applicable sales, use, VAT, or other taxes imposed by your jurisdiction, unless expressly stated otherwise at checkout.

4.3 Subscriptions and Recurring Billing

If DriveIndex is ever offered on a subscription basis (for example, monthly or annually):

You will be billed in advance on a recurring schedule as shown at purchase.
Your subscription may automatically renew unless you cancel before the renewal date.
You authorize recurring charges to your selected payment method until you cancel.

Any subscription and recurring billing terms, if applicable, will be clearly presented at the time of purchase. At this time, DriveIndex may be a one-time purchase; if no subscription is offered, this section may not apply to you.

5. Acceptable Use and User Conduct

You agree not to:

Use the Site or App for any unlawful, harmful, or fraudulent purpose
Attempt to gain unauthorized access to our systems or other users’ data
Interfere with or disrupt the normal operation of the Site or App
Reverse engineer, decompile, or attempt to access the source code of the App except where permitted by applicable law
Modify, distribute, or resell license keys or access credentials without our permission

We may suspend or disable your license or access if we reasonably believe you have violated these Terms.

6. Intellectual Property

6.1 Our Rights

The Site, the App, and all related content, including but not limited to text, graphics, logos, icons, images, interface designs, and software code (collectively, the “Company Content”) are owned by or licensed to Neon Media and are protected by intellectual property laws.

Subject to these Terms and any license terms provided at purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your own personal or internal business use.

You may not:

Copy, modify, or create derivative works based on the App except as allowed by law
Distribute, sublicense, or resell the App or license keys to others
Remove or alter any copyright notices, trademarks, or other proprietary markings

6.2 Trademarks

“DriveIndex,” “Neon Media,” and associated logos are trademarks or service marks of Neon Media, LLC or its licensors. You may not use our names or logos without our written permission, except as necessary to identify the App in a truthful manner (for example, in a review).

7. Third-Party Services and Links

The Site and App may reference or rely on third-party services, including but not limited to Gumroad (payment processing and license fulfillment), Google Analytics (website usage analytics), and TelemetryDeck (anonymous in-app usage analytics). The Site may also include links to third-party websites or documentation. We do not control third-party sites or services and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and may be governed by additional terms and privacy policies provided by those third parties.

8. Disclaimers

To the fullest extent permitted by law:

The Site and App are provided “as is” and “as available” without warranties of any kind, whether express or implied.
We do not warrant that the App will be error-free, that it will work on all hardware or configurations, or that it will meet your specific requirements.
We do not guarantee that the Site or App will be continuously available, secure, or free from viruses or other harmful components.

If you are dissatisfied with the Site or App, your sole remedy is to stop using them and, where applicable, request a refund in accordance with our Refund Policy below.

9. Limitation of Liability

To the fullest extent permitted by law, Neon Media, LLC and its owners, members, managers, employees, and contractors will not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, goodwill, or other intangible losses

arising out of or related to your use of or inability to use the Site or App, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising out of or related to the App or Site will be limited to the amount you paid for DriveIndex in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations of liability. In those cases, the above limitations apply only to the extent allowed by law.

10. Indemnification

You agree to indemnify and hold harmless Neon Media, LLC and its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to your use or misuse of the Site or App, your violation of these Terms, or your violation of any rights of another person or entity.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services will be resolved: (1) first, through good faith negotiations between you and Neon Media, LLC; (2) if unresolved, through mediation or arbitration if both parties agree in writing; and (3) otherwise, through the state or federal courts located in Rutherford County, Tennessee. You consent to the exclusive jurisdiction and venue of those courts.

Privacy Policy (DriveIndex.app and DriveIndex App)

This Privacy Policy explains how Neon Media, LLC collects, uses, and shares information in connection with the DriveIndex website (driveindex.app) and the DriveIndex macOS app. By using the Site or App, you consent to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide Voluntarily

You may choose to provide information such as your name and email address (for support, contact, or newsletter signup); information you include in support requests or feedback messages; and license-related details if you contact us to look up or modify your purchase.

Payment and billing information (such as your name, billing address, and payment method) is collected and processed by Gumroad, not stored in full by Neon Media. We may receive limited details from Gumroad, such as your email address, confirmation that a purchase occurred, product purchased and pricing, and country or region for tax purposes.

1.2 Information Collected Automatically on the Website (driveindex.app)

When you visit the Site, certain information may be collected automatically, including IP address, browser type and version, device type, pages viewed and time spent on pages, referring URLs, and date and time of access. The Site uses Google Analytics to help us understand how visitors interact with the website. Google Analytics may use cookies and similar technologies to collect and analyze usage information.

1.3 Information Collected Automatically in the App (DriveIndex)

The DriveIndex app uses TelemetryDeck to collect anonymous or pseudonymous usage data. This may include general technical information about the app version and operating system; basic information about how you interact with features; and non-identifying technical metrics that help us understand performance and stability. TelemetryDeck is designed so that we do not receive information that directly identifies you (such as your name or email) from in-app analytics.

1.4 Information From Third Parties

We may receive limited information from third-party services, such as Gumroad (basic purchase and license information for DriveIndex), email providers (metadata related to messages you send us), and analytics providers (aggregated statistics and metrics about usage).

2. How We Use Your Information

We use the information described above to provide, maintain, and improve the Site and App; process and verify purchases of DriveIndex; provide customer support and respond to inquiries; understand how users interact with the App and Site; detect and address errors, security issues, and misuse; and comply with legal obligations and enforce our rights.

We may also use your contact information to send important notices about security updates, critical app updates, and changes to these Terms. We may send optional marketing or product update emails only where permitted by law and where you have not opted out.

3. Cookies and Analytics

3.1 Cookies on driveindex.app

The Site may use cookies and similar technologies, primarily through Google Analytics, to understand how visitors use the Site, measure and improve performance, and remember certain preferences. You can control cookies through your browser settings.

3.2 Telemetry in the App

The App uses TelemetryDeck to collect anonymized or pseudonymized analytics data. This data is not intended to identify you personally and is used only to improve the App’s performance, stability, and user experience.

4. Data Sharing

We may share information with service providers (including Google Analytics, TelemetryDeck, Gumroad, and email/support tools); as required by law or to protect rights, property, or safety; and in connection with business transfers such as a merger, acquisition, or asset sale. We do not sell your personal information in the common consumer sense of "sell."

5. Data Retention

We retain information for as long as reasonably necessary to provide and maintain the App and Site, support and document purchases and licenses, comply with legal, accounting, and reporting obligations, and resolve disputes and enforce agreements. When information is no longer needed, we will delete it or anonymize it, subject to any legal requirements.

6. Data Security

We take reasonable measures to protect the information we collect, including technical and organizational safeguards. However, no method of transmission over the internet or electronic storage is completely secure.

7. Your Rights and Choices

Depending on your location, you may have rights regarding your personal information, including access, correction, deletion (subject to limits), objection or restriction of processing, withdrawal of consent, and opting out of marketing communications. To exercise any of these rights, contact us at hello@neonmedia.co. We may need to verify your identity before fulfilling certain requests.

8. Children’s Privacy

The Site and App are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will take steps to delete it.

9. International Data Transfers

Your information may be transferred to, stored in, and processed in countries other than your own, including the United States. Where required by law, we will implement appropriate safeguards to protect your information when it is transferred internationally.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site or App after changes take effect means you accept the updated Privacy Policy.

Refund Policy (DriveIndex)

Applicability

This Refund Policy applies to purchases of the DriveIndex app that are processed through Gumroad or any other direct sales mechanism we specify on the driveindex.app website.

Platform purchases

Purchases made through other platforms (for example, if DriveIndex is ever offered through an app store) will be subject to that platform's own refund policy. In those cases, you must follow the refund process provided by that platform.

Seller and Payment Processor

Neon Media, LLC is the seller of DriveIndex. Gumroad acts as our payment processor and handles the transaction on our behalf. Refunds are processed by Neon Media through Gumroad's platform and are subject to both our refund terms and Gumroad's terms of service.

Refund Window

For DriveIndex purchases processed through Gumroad, you may request a refund within thirty (30) days of the original purchase date.
Requests made after this 30-day period may not be eligible for a refund, except where a longer period is required by applicable consumer protection laws in your jurisdiction.

Refund Eligibility

We generally honor refund requests made within the 30-day window for reasons including:

The software does not work as described on our website
Technical issues that prevent the app from functioning on your supported macOS version
Duplicate purchases made in error
You changed your mind within the refund window

Consumer Rights

If you are a consumer in certain jurisdictions (such as the EU, UK, or Australia), you may have statutory rights including:

The right to cancel your order within a specific period (for example, 14 days from purchase in the EU)
The right to a remedy if the product is defective, not as described, or not fit for purpose
Additional protections under local consumer protection laws

Nothing in this Refund Policy limits your statutory consumer rights. Where local law provides stronger protections than stated here, those laws will apply.

Refund Limitations

We reserve the right to refuse refunds in cases of:

Suspected fraud or refund abuse (such as repeated purchase and refund patterns)
Violation of our Terms of Service
Requests made significantly outside the 30-day window (except where required by law)
Refunds for reasons unrelated to product functionality (for example, change of operating system or hardware)

How to Request a Refund

To request a refund for a DriveIndex purchase made via Gumroad:

Email us at hello@neonmedia.co with your order number, purchase email, and reason for the refund request
Include your Gumroad order/receipt number (found in your purchase confirmation email)
We will review your request and respond within 2-3 business days
If approved, refunds are typically processed within 5-10 business days and will appear on your original payment method

Alternatively, you may also request a refund directly through Gumroad by accessing your purchase receipt and using their refund request system. Gumroad provides sellers with tools to process refunds, and we monitor those requests regularly.

Subscription Purchases

If DriveIndex is offered on a subscription basis in the future:

You may cancel your subscription at any time
Cancellation will prevent future charges but will not automatically refund the current billing period
Refund requests for the current period will be evaluated on a case-by-case basis within the 30-day window
You will retain access to DriveIndex until the end of your current billing period after cancellation

Currently, DriveIndex is offered as a one-time purchase, and this subscription section may not apply.
